1. Agreement to Terms

By accessing or using the services of CA Design Specialist ("Company," "we," "our," or "us"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you and CA Design Specialist, a DBA of P.C.P.M. Inc., License #1094494.

2. Services Description

CA Design Specialist provides professional architectural design services, including but not limited to:

• New home design and planning
• Floor plan design and modifications
• Exterior design services
• Plan revisions and updates
• Construction plans and documentation

All services are subject to availability and may be modified or discontinued at our discretion.

3. User Responsibilities

By using our services, you agree to:

• Provide accurate and complete information
• Maintain the confidentiality of your account information
• Notify us immediately of any unauthorized use
• Comply with all applicable laws and regulations
• Not use our services for any unlawful purpose
• Not interfere with or disrupt our services

4. Project Agreements and Contracts

Specific project terms, including scope of work, timelines, deliverables, and fees, will be outlined in separate project agreements or contracts. These project-specific agreements supplement and are governed by these Terms and Conditions.

All design work remains the property of CA Design Specialist until full payment is received, unless otherwise specified in writing.

5. Payment Terms

• Payment terms will be specified in individual project agreements
• Deposits may be required before work commences
• Late payments may incur additional fees
• We reserve the right to suspend services for non-payment
• All fees are non-refundable unless otherwise stated in writing

6. Intellectual Property Rights

All content, designs, plans, drawings, and materials created by CA Design Specialist are protected by copyright and other intellectual property laws. Upon full payment, clients receive a limited license to use the designs for the specific project purpose.

Clients may not reproduce, distribute, or create derivative works from our designs without express written permission.

7. Revisions and Changes

The number of revisions included in each project will be specified in the project agreement. Additional revisions beyond the agreed scope may incur extra charges. We reserve the right to refuse unreasonable revision requests.

8. Project Timelines

While we strive to meet all project deadlines, timelines are estimates and may be affected by factors beyond our control, including client delays in providing information or approvals. We are not liable for delays caused by circumstances outside our reasonable control.

9. Limitation of Liability

To the maximum extent permitted by law, CA Design Specialist shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claims arising from our services shall not exceed the amount paid by the client for the specific project in question.

10. Professional Standards and Licensing

CA Design Specialist operates under License #1094494 and adheres to all applicable professional standards and building codes. However, clients are responsible for obtaining all necessary permits and ensuring compliance with local regulations.

We recommend that clients consult with local authorities and licensed contractors regarding specific building requirements.

11. Warranties and Disclaimers

Our services are provided "as is" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or meet your specific requirements.

We warrant that our work will be performed in a professional manner consistent with industry standards, but we make no guarantees regarding construction costs, building approval, or project outcomes.

12. Indemnification

You agree to indemnify and hold harmless CA Design Specialist, its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.

13. Termination

Either party may terminate a project agreement with written notice. Upon termination:

• Client remains responsible for payment of work completed
• All materials and designs remain property of CA Design Specialist until full payment
• We reserve the right to terminate services for breach of these Terms

14. Confidentiality

We respect the confidentiality of client information and will not disclose project details without permission, except as required by law or to fulfill our contractual obligations.

15. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in California, and the decision shall be final and binding.

You waive any right to participate in a class action lawsuit or class-wide arbitration.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified Terms.

19. Entire Agreement

These Terms, together with any project-specific agreements, constitute the entire agreement between you and CA Design Specialist regarding our services and supersede all prior agreements and understandings.
